1. Object of agreement
These Conditions of Use apply to all deliveries of Geschenkeland-Erzgebirge.de to consumers (according to § 13 BGB).

2. Contract formation
A contract between the customer and Geschenkeland-Erzgebirge.de comes only through an order of the customer and the adoption by Geschenkeland-Erzgebirge.de to effect. The customer's order is in writing or via the Internet. Geschenkeland-Erzgebirge.de accepts the order by sending the customer a confirmation (by e-mail or postal mail) or by delivering the ordered goods. The in the shop displayed products are not a legally binding offer. All displayed goods are considered "while stocks last" available. Errors excepted.

3. Payment terms
From Germany: The Payment will be made either by prepayment (EFT), cash on delivery or via PayPal. If you starting a second order, we offer you an additional payment by invoice.

From other Countries: For orders from abroad (all countries except Germany), we offer you prepayment (bank transfer or cheque)and the payment through PayPal.

4. Reservation of proprietary rights
Until the full payment the arcticles remain in possession of Geschenkeland-Erzgebirge.de.

5. Delivery terms
We deliver our goods worldwide. Orders from within Germany are generally within 3-5 business days sent. If it is difficult to supply the manufacturer, you are immediately informed of us. In this case, you can cancel the order, wait for the product or choose an equivalent replacement item. For the Christmas time from November you must calculate on a turnaround time of about 10 days. Shipments abroad are 3-5 business days after receipt of payment sent by us. The duration of the mission depends on the recipient country.

6. Prices and shipping costs
The prices on the product pages are include VAT of 19%. If you are logged in from a non-EU country, this tax will be deduct.

In addition to the prices we charge for delivery within Germany a Handling charge of 6,50 euro per order. The shipping costs will show you in the cart system and the order page again significantly. For payment by cash on delivery (COD) fall to the designated shipping additional costs in the amount of 6,00 euro.

7. Return policy
You may have received goods without giving a reason within two weeks by returning the goods back. The period begins with the receiving of goods. In order to respect the time limit is sufficient to send the goods or to inform us of the return. In any case, the return on our costs and risk. The right of return is not in the case of opened CDs or DVDs, food and goods, which according to their wishes specially prepared for you.

Return procedure: In the case of an effective return are of the both sides to return the performance and any benefit (such as utility benefits) surrendered. Before returning always send us an email (shop@geschenkeland-erzgebirge.de) or phone us(after 4 p.m.). Please use for a possible return the original packaging with all accessories and avoid damage and contamination. If the original packaging is no longer possess, please provide a suitable packaging for a sufficient protection against transit damage. Sending the goods please as insured package back to us and keep on the shipment receipt.

8. Jurisdiction and applicable law
Jurisdiction is the county court of Annaberg-Buchholz in Germany. The legal relationship under the German law to the exclusion UN purchasing law.

9. Guarantee
The warranty is in accordance with statutory provisions. In all, while the statutory warranty period of two years of delivery, occurring defects have the legal right to supplementary performance (errors elimination or replacement)

11. Severability clause
If any provision or provisions of this Agreement shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
